As you both mutually agree to a settlement and file for a “no-fault divorce” under Section 13 B of the Hindu Marriage Act 1955. All marriages which have been solemnized before or after the Marriage Laws (Amendment) Act 1976, are entitled to make use of the provision of divorce by mutual consent. However, for filing for a divorce on this ground, it is necessary for the husband and wife to have lived separately for at least a year.

Builders associations such as CREDAI, MCHI, etc., do have grievance redressal forums. You could approach them, since an out of court settlement can be a win-win for both parties involved. If that doesn’t work, you could hire a lawyer for yourself and look at legal means through which your individual cases can be resolved.

If possession is not delivered on time, a purchaser can send a notice to the builder, claiming refund of the amounts paid along with interest and/or damages. “The buyer can also file a consumer complaint for ‘deficiency in service’ as defined under the Consumer Protection Act, 1986 against the builder,”

In India all adoption issues are handled by the Central Adoption Resource Authority (CARA), an autonomous body governed by the Ministry of Women & Child Development.– A minimum age difference of 21 years between the single mother and the adopted child is required if they’re of opposite sexes.

      – A single parent should be between 30 – 45 years in age if she wishes to adopt a child in the age group of 0-3 years. The upper limit for a child older than 3 years is 50.– The single parent should have an additional family support.

      – According to the rules the adoptive parent has to be both medically fit and financially settled.

      – According to the Hindu Adoption and Maintenance Act of 1956 Indian citizens who are Hindus, Jains, Sikhs, or Buddhists are allowed to adopt not more than one child of a particular sex.

      – For foreigners, NRIs and those Indian nationals who are Muslims, Parsis, Christians or Jews, according to the Guardian and Wards Act of 1890, the parent only acts as a guardian till the child attains the age of 18.

      – One can adopt a child from recognised private placement agencies, Shishu Grehas or State Adoption Cells.

Mr. Neelesh you immediate inform bank and lodge police complaint too. it usually happens people lost their documents even cheque book also but it seems strange that the cheque book contains blank cheques……. if any body file complaint against you under NI act then it will create problems for you, so to escape any such circumstances immediate act what was suggested above.

My father passed away recently and my mother had died before that. I heard I have to obtain a legal succession certificate. Where can I get that from?

    • From 24×7 Legal Advice
      on Questions

You would be requiring a succession certificate only if your father has died intestate, that is he dies without making a will. The civil court having appropriate jurisdiction would be issuing the certificate. You have to apply for the same in the form of a petition paying appropriate court fees.

I had an arranged marriage 3 years back but have not been able to adjust with my spouse and she also feels the same. We are both Hindus. We would like to get a divorce. What would you suggest?

      on Questions

The most convenient way for you both to get a divorce would be to be a divorce by mutual consent under Hindu Marriage Act. Kindly consult a lawyer for the same. The paperwork is minimum and the process is quite easy and effective. After filing of first motion by both parties the second motion has to be filed after 6 months and the decree of divorce is then granted.

I am giving my property for lease and someone advised me to go for a lease period of 11 months as opposed to 12 months or more. Please advice.

A lease agreement for 11 months does not require to be registered. That is why it is preferred more by the landlords while leasing properties out. If your lease is not a commercial one a 11 month agreement would be more convenient. Do not hesitate to contact us if you need further clarification.

      on Questions

One way of doing this would to approach a lawyer and file a MVA Case before the same court and then file an application for the consolidation of your maid’s case along with the case that was filed by the in laws. This would ensure that your maid gets her share. Do not hesitate to contact us if you need further clarification.

It is important to know the cause for the divorce to be able to proceed under Muslim laws. Muslim laws provide for very select reasons as to why a divorce maybe initiated by the wife. Delegated divorce is one way although it is a rarity. Generally speaking the wife can divorce her husband if there is any adultery or unchastity.
